PLATFORM POLICIES
Rules for a trusted music marketplace.
These policies are Songberd's terms of use and privacy policy. They cover accounts, competitions, uploaded content, ticketing, payouts, messaging, scouting, copyright, privacy, data rights, and enforcement across the website and mobile apps.

Who We Are And Agreement To These Terms
- —Songberd is operated by Ajolla Inc. By creating an account or using the Songberd website or mobile app, you agree to these policies, which function as the platform terms of use.
- —If you do not agree with these policies, do not use the platform.
- —We have zero tolerance for objectionable content and abusive users. Content and accounts that violate these policies may be removed without notice.
- —These policies may be updated as the product, laws, payment requirements, and safety needs evolve. Continued use after an update constitutes acceptance. Material changes will be reflected in the "Last updated" date above.
Accounts And Eligibility
- —You must be at least 13 years old (or older where local law requires a higher minimum age for digital consent) to create an account. Songberd is not directed to children under 13, and we do not knowingly collect personal information from them.
- —You must provide accurate account information and keep your login credentials secure.
- —Artists, listeners, and A&R users may only use roles and features they are authorized to access.
- —Restricted accounts may be blocked from creating videos, events, comments, follows, messages, competition entries, or payout activity.
- —Banned accounts may be removed from public discovery, playback, competitions, messaging, and ticketing surfaces.
Competition Rules
- —Each artist may enter only their own eligible video in an open competition.
- —Entries must be submitted while the competition is live and before the published closing time.
- —Votes must reflect genuine user activity. Vote buying, coordinated manipulation, automated voting, and fake engagement are prohibited.
- —Songberd may review, disqualify, or withhold payout for entries that violate platform rules, rights requirements, or safety standards.
Prizes And Taxes
- —Competition prizes are paid in the amount and currency published for that competition, to the winning artist’s connected Stripe account.
- —No purchase is necessary to enter a competition or to vote.
- —Winners are solely responsible for any taxes, reporting obligations, and fees that apply to prize income in their jurisdiction.
- —Prizes may be withheld, reclaimed, or reversed where the winning entry violated these policies, where required by law, or where payment to the winner is prohibited or fails compliance checks.
- —Competitions are void where prohibited by law.
Content And Intellectual Property
- —You must own or have the necessary rights to upload, perform, stream, distribute, and monetize any content you post.
- —Do not upload content that infringes copyrights, trademarks, publicity rights, privacy rights, or contractual obligations.
- —Do not post illegal content, explicit sexual content, targeted harassment, hateful conduct, threats, or instructions for harm.
- —Songberd may remove content or limit distribution when content is reported, violates policy, creates legal risk, or degrades platform trust.
Copyright Complaints (DMCA)
- —If you believe content on Songberd infringes your copyright, send a notice to support@songberd.com including: identification of the copyrighted work, the URL or location of the infringing material, your contact information, a good-faith statement that the use is unauthorized, a statement under penalty of perjury that the notice is accurate and you are authorized to act for the rights holder, and your physical or electronic signature.
- —Users whose content is removed may submit a counter-notice with the same contact containing identification of the removed material, a statement under penalty of perjury of a good-faith belief the removal was a mistake or misidentification, consent to jurisdiction, and a signature.
- —Songberd terminates the accounts of repeat infringers.
- —Misrepresenting that material is infringing (or was removed by mistake) can expose you to liability.
Live Events And Ticketing
- —Hosts are responsible for accurate event descriptions, start times, venue details, ticket tiers, and fulfillment of the advertised show.
- —Ticket sales use Stripe-hosted checkout. Stripe processing rules, identity checks, and payout requirements apply.
- —Canceled, ended, or restricted-account events may be blocked from checkout.
- —Hosts must comply with venue, livestream, tax, consumer protection, and local event rules that apply to their events.
Payments, Payouts, And Refunds
- —Prize payouts and ticket payouts require a valid connected Stripe account and may be delayed for review, fraud checks, disputes, or compliance.
- —Platform fees and Stripe fees may be deducted from ticket transactions before host payout.
- —Refunds are handled case by case for canceled events, duplicate charges, failed fulfillment, or legal requirements.
- —Chargebacks, payment disputes, and suspected fraud may reduce balances, delay payouts, or restrict account features.
Messaging And Community Conduct
- —Messaging is for legitimate fan, artist, collaboration, support, and scouting communication.
- —Spam, phishing, impersonation, threats, harassment, sexual exploitation, and attempts to move users into unsafe transactions are prohibited.
- —Songberd may rate-limit, review, restrict, or remove messaging access to protect users and platform integrity.
- —Do not share private personal information about another person without consent.
Reporting, Blocking, And Safety
- —Any user can report a video, profile, message, or event that appears to violate these policies, either through in-product report actions or by emailing support@songberd.com.
- —Reports of objectionable content are reviewed promptly, and content that violates these policies is removed and the offending user actioned within 24 hours of a verified report.
- —You can block another user to stop them from messaging you; blocked users are also hidden from your messaging surfaces.
- —If you believe someone is in immediate danger, contact local emergency services first, then report the account to us.
A&R And Scouting
- —A&R tools are for legitimate scouting and label workflow use.
- —Saved artists, submissions, and scouting notes must be handled confidentially by authorized team members.
- —Do not misrepresent label affiliation, offer fraudulent deals, or solicit artists for unrelated services.
- —Artist data visible in the scouting portal may not be scraped, resold, or used outside legitimate music discovery and business evaluation.
Privacy And Data Use
- —Songberd uses account, profile, content, engagement, payment, and device information to operate the platform, prevent abuse, and improve discovery.
- —Public profile information, public videos, public event details, and public engagement counts may be visible to other users and search engines where allowed.
- —Payment details are processed by Stripe; Songberd does not store full card numbers.
- —Location data in the mobile app is requested only to sort live events near you. Your coordinates are used on your device and are not stored on Songberd servers. You can deny or revoke location access at any time in system settings; the app continues to work without it.
- —We retain account data while your account is active and for a limited period afterward as needed for fraud prevention, payment disputes, and legal compliance.
Your Data Rights And Account Deletion
- —You can request a copy of your personal data, correction of inaccurate data, or deletion of your account and associated personal data by contacting support@songberd.com from your account email, or using the in-product account controls.
- —Deleting your account removes your profile from public surfaces and schedules deletion of your personal data, except records we must keep for payments, tax, fraud prevention, or legal obligations.
- —Depending on where you live, you may have additional rights under laws such as GDPR or CCPA, including the right to object to processing and the right to lodge a complaint with a supervisory authority. We do not sell your personal information.
Third-Party Services
- —Supabase provides authentication, database, and media storage infrastructure.
- —Stripe processes payments, payouts, and identity verification for connected accounts. Stripe’s own terms and privacy policy apply to payment data.
- —Vercel hosts the web application.
- —Sentry receives crash and error reports from the apps so we can fix defects; reports are limited to technical diagnostics.
- —Event addresses entered by hosts are geocoded via OpenStreetMap’s Nominatim service to enable distance sorting; only the host-entered venue/city text is sent, never user location.
Moderation And Enforcement
- —Songberd may warn, remove content, limit visibility, restrict features, suspend accounts, ban accounts, reverse inauthentic activity, or report illegal conduct.
- —Enforcement decisions may consider account history, severity, legal risk, user safety, payment risk, and platform integrity.
- —Users may contact support about moderation, payment, ticketing, or safety issues using the support address below.
- —These policies may change as the product, laws, payment requirements, and safety needs evolve.
Disclaimers And Limitation Of Liability
- —Songberd is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- —Songberd is a platform: artists, hosts, and labels are independent users, not employees or agents of Songberd, and Songberd is not a party to deals, bookings, or agreements made between users.
- —To the maximum extent permitted by law, Ajolla Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the platform.
- —To the maximum extent permitted by law, our total liability for any claim relating to the platform is limited to the greater of $100 or the amounts you paid to Songberd in the twelve months before the claim.
- —Nothing in these policies limits liability that cannot be limited under applicable law, or affects statutory consumer rights in your jurisdiction.
